Maine Living Will

If you think you don’t have much, consider that the less you have the more your family needs a well written estate plan to see that it goes to them, not taxes and attorneys. Some of the biggest fights in estates can occur over personal items such as a sterling silver tray or a family heirloom. Planning ahead can avoid costly court actions and family fueding that may never be repaired. Make those decisions now while you still can. 75 percent of Americans don’t have a will.

The Living Will statute covering Proxy Directives specifically protects the patient’s “Health Care Representative” from liability. The law states that the “Health Care Representative” is not imposed with any liability for any portion of the person’s health care costs, not subject to criminal or civil liability for any action performed in good faith and in accordance with the provisions of the act to carry out the terms of the Advance Directive.
